Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MNY WAY platform ("MNY WAY", "we", "us") and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Accounts and roles

MNY WAY supports multiple account roles, including merchant, affiliate, and admin. You are responsible for all activity that occurs under your account, and for keeping your login credentials confidential.

2. Use of the Service

You agree not to:

• Use the Service for any unlawful, fraudulent, or abusive purpose.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to the Service or related systems.
• Send spam or otherwise violate applicable advertising, privacy, or anti-spam laws.

3. Merchants

As a merchant, you are responsible for your offers, landing pages, pricing, order processing, and fulfilment. You must ensure that your programs and promotional materials comply with applicable laws and with any program-specific rules you publish for affiliates.

4. Affiliates

As an affiliate, you are responsible for your traffic sources and promotional methods. You must not mislead users, impersonate merchants, or engage in prohibited tactics such as cookie stuffing, ad fraud, or unauthorised email campaigns.

5. Tracking, attribution, and reporting

MNY WAY provides tracking links, cookies, and APIs to attribute clicks and conversions between merchants and affiliates. While we design the platform for reliability, attribution and reporting may be impacted by factors outside our control (such as ad blockers, browser behaviour, or third-party outages). Reports are provided on a best-effort basis and may be adjusted to correct errors or fraud.

6. Fees and payouts

Commission structures, payout terms, and currencies are configured at the program level by merchants and/or the network operator. MNY WAY may facilitate reporting and exports for payouts, but final responsibility for paying affiliates rests with the merchant or network operator as applicable.

7. Intellectual property

MNY WAY and its licensors retain all rights, title, and interest in and to the Service, including all software, trademarks, and related intellectual property. You may not copy, modify, or create derivative works of the Service except as permitted by these Terms or applicable law.

8. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, MNY WAY will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any loss of revenue, profits, data, or goodwill, arising out of or in connection with your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or are using the Service in a way that could cause harm to us, other users, or third parties.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
